This is an English translation of our Dutch privacy statement. In the event of any discrepancy, the Dutch version prevails.

RUDIQ B.V., hereinafter referred to as RUDIQ, attaches great importance to the protection of personal data. In this privacy statement we explain which personal data we process, why we do so, how we secure this data and what rights you have.

This privacy statement applies to the use of our website, contact forms, communication, demo requests, brochure requests, advisory services and future software services relating to TPM Digital.

1. Contact details

RUDIQ B.V. is responsible for the processing of personal data as set out in this privacy statement.

2. Personal data we process

RUDIQ processes personal data because you use our website or services, or because you provide this data to us yourself.

We may process the following personal data:

• first and last name;
• company name;
• job title;
• business e-mail address;
• business telephone number;
• address details of the organisation;
• data you enter yourself in a contact form, demo request or message;
• communication data, such as e-mails, conversation notes and appointments;
• data relating to quotations, agreements, invoicing and administration;
• technical data, such as IP address, browser data, device type and website use;
• data about your interest in our services, such as TPM Digital, pilots, demos or advisory projects.

In principle we do not process special categories of personal data, such as medical data, religion, political preference, criminal data or other sensitive personal data.

3. Special and/or sensitive personal data

Our website and services do not intend to collect data about website visitors younger than 16 years of age, unless they have permission from a parent or guardian.

However, we cannot verify whether a visitor is older than 16. If you are convinced that we have collected personal data about a minor without permission, please contact us at info@rudiq.nl. We will then delete this data.

4. For what purpose do we process personal data?

RUDIQ processes personal data for the following purposes:

• to contact you in response to a question, contact form or request;
• to send information about RUDIQ, TPM Digital, demos, pilots or collaborations;
• to plan and follow up on appointments;
• to draw up quotations, agreements and invoices;
• to perform our services;
• to manage client relationships and business contacts;
• to improve our website and communication;
• to comply with legal obligations, such as tax administration;
• to safeguard the security and operation of our website, systems and software;
• to inform you about changes to our services or products.

5. Legal grounds for processing

We only process personal data when there is a valid legal ground for doing so under the GDPR. The main grounds are:

Performance of an agreement

For example when we carry out a demo, pilot, advisory project, implementation or software service.

Legitimate interest

For example for normal business contact, relationship management, improvement of our website and services, security of systems and follow-up of business requests.

Legal obligation

For example for administration, invoicing and statutory retention obligations.

Consent

For example when you sign up for a newsletter or when we use cookies for which consent is required.

6. Automated decision-making

RUDIQ does not take decisions based on automated processing that could have significant consequences for individuals.

This means that no decisions are made by computer programs or systems without human intervention that have significant consequences for data subjects.

7. How we secure personal data

RUDIQ takes appropriate technical and organisational measures to protect personal data against loss, misuse, unauthorised access, unwanted disclosure and unauthorised modification. These include:

• secure connections via SSL;
• access security for systems;
• limited access to personal data;
• use of reliable hosting, software and IT partners;
• internal confidentiality agreements;
• security of accounts and systems;
• regular review and improvement of our processes.

8. Cookies and similar techniques

RUDIQ may use cookies and similar techniques. We may use:

Functional cookies

These are necessary to make the website work properly.

Analytical cookies

These help us gain insight into the use of our website so that we can improve it.

Marketing or tracking cookies

These are only used if we ask for your consent, for example via a cookie banner.

On your first visit to our website we inform you about the use of cookies. For cookies that require consent, we ask for consent in advance.

You can disable or delete cookies via your browser settings.

Our website may use cookies or techniques from third parties, such as:

• Google Analytics;
• Google Ads;
• LinkedIn;
• Microsoft Clarity;
• other marketing or analytics tools, if we use them.

9. How long do we keep personal data?

RUDIQ does not keep personal data longer than is necessary for the purpose for which the data was collected, unless we are legally required to keep data longer. The GDPR is based on the principle that personal data may not be kept longer than necessary for the purpose of the processing.

In broad terms we apply the following retention periods:

Demo and brochure requests	maximum 2 years after last contact
Quotations and business communication	maximum 7 years if administratively relevant
Client and contract data	during the collaboration and thereafter a maximum of 7 years
Invoice and administration data	7 years due to the statutory tax retention obligation
Newsletter data	until you unsubscribe
Website and analytics data	depending on cookie settings and the tools used

10. Sharing personal data with third parties

RUDIQ does not sell personal data to third parties.

We only share personal data when this is necessary for our services, business operations or legal obligations. We may share personal data with, for example:

• hosting parties;
• the website administrator;
• the software development partner;
• the e-mail provider;
• the bookkeeper or accountant;
• CRM or administration software;
• IT and security suppliers;
• legal or financial advisers;
• parties required for the performance of an agreement.

When these parties process personal data on our behalf, we make appropriate arrangements regarding security, confidentiality and use of data. Where necessary we conclude a data processing agreement.

11. Use of TPM Digital

When you use TPM Digital, or when we carry out a demo, pilot or implementation, additional arrangements may be required regarding the processing of personal data. In that case, arrangements may be made about, among other things:

• which personal data is processed in TPM Digital;
• who is the controller and/or processor;
• security and access rights;
• user roles and authorisations;
• logging and system use;
• retention periods;
• support;
• any sub-processors;
• the rights of data subjects.

When using TPM Digital as a software platform, a separate data processing agreement may be required between RUDIQ and the client.

12. Newsletter and commercial communication

When you sign up for a newsletter, information request or demo request, we may use your data to send you relevant information about RUDIQ, TPM Digital, events, developments or services.

You can unsubscribe at any time via the unsubscribe link in the e-mail or by contacting us at info@rudiq.nl.

13. Viewing, amending or deleting data

You have the right to view, correct or delete your personal data. In addition, you have the right to:

• withdraw your consent;
• object to processing;
• request restriction of processing;
• request data portability;
• lodge a complaint with the Dutch Data Protection Authority.

You can send a request to info@rudiq.nl.

To make sure that the request was made by you, we may ask for additional information to confirm your identity. We respond as quickly as possible, but no later than within the statutory period.

14. Complaints

Do you have a complaint about how we handle personal data? Please first contact us at info@rudiq.nl. We will try to reach a suitable solution together.

You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

15. Changes to this privacy statement

RUDIQ reserves the right to amend this privacy statement. The most up-to-date version is always available on our website.
